These General Terms and Conditions (hereinafter the “GTC”) set out the general terms applicable to ordering, over the internet at www.tavikajewelry.com, the products sold by Németh-Tavasz Brigitta Egyéni Vállalkozó (sole trader) (hereinafter the “Trader”). By registering, the user (hereinafter the “Buyer”, “customer” or “consumer”) accepts the terms set out in this document.

1.2 Purchasing from Németh-Tavasz Brigitta Györgyi Egyéni Vállalkozó is conditional on the Buyer’s valid registration. By completing and submitting the registration form found at www.tavikajewelry.com, the Buyer simultaneously accepts these terms and acknowledges them as binding upon themselves, without modification.

1.3 If the Buyer is not yet registered with Németh-Tavasz Brigitta Egyéni Vállalkozó, they must complete and submit the registration form with accurate details before making a purchase.

1.4 Any application form that contains one or more errors, whether immediately apparent or discovered later, will be declared invalid. We accept no responsibility whatsoever for any incorrect performance resulting from incorrectly provided data.

2. Formation of the contract

No legal relationship is formed between the Buyer and the Seller through use of the website at tavikajewelry.com. The contract of sale or delivery is formed between the Buyer and the Seller at the moment the product is handed over.

3. Delivery terms

The customer will receive a notification at the e-mail address they provided if Németh-Tavasz Brigitta Györgyi Egyéni Vállalkozó is unable to ensure delivery of the product within the stated 1 week.

3.2 Németh-Tavasz Brigitta Györgyi Egyéni Vállalkozó is a registered business partner of FoxPost Kft. and Magyar Posta Zrt. The shipping fee is:

3.3 In the case of cash-on-delivery parcels, the above amounts increase by HUF 480. During the confirmation of the order, our system automatically adds the cost corresponding to the chosen shipping and payment method to the purchase price.

3.4 For orders over HUF 100,000, the shipping costs are covered by the Trader.

4. Prices, payment method, payment

4.1 The Seller reserves the right to change prices. The official, generally applicable gross retail prices are those shown on the product pages of this website. Deviation from these is only possible in the case of promotional and sale offers, or where a purchase-discount coupon is held.

4.2 The Buyer may purchase the in-stock product shown on the order form at the prices in effect at the time the order is submitted. In the case of an order for a product that is not in stock, the customer may purchase the product at the price in effect when it comes back into stock. The Buyer receives confirmation of the acceptance of the order at the e-mail address they provided. Under Act V of 2013 on the Civil Code (hereinafter the “Civil Code”), the contract is formed through the mutual and concurring expression of the parties’ intent.

4.3 Prices shown on the tavikajewelry.com website are in all cases exempt from value added tax, and do not include delivery costs. The delivery cost of products purchasable on the website is set out in point 3, Delivery Terms.

4.4 When purchasing on the tavikajewelry.com website, the price of products may be paid by cash on delivery, by bank card, by advance bank transfer, or by PayPal.

4.6 The Trader reserves the right to satisfy itself as to the accuracy of the registration details, and to delete the registration if the accuracy of the data contained therein is questionable or unintelligible.

5. Warranty

5.1 In the event of defective performance of an order (where the service does not, at the time of performance, meet the quality requirements set out in the contract or in legislation), the consumer may, within 6 months following performance, request repair or replacement of the product, a price reduction, or may withdraw from the contract. In the case of a contract between a consumer and a business for the sale of goods qualifying as movable property, within the exercise of the consumer’s warranty-for-defects rights, the consumer may not repair the defect themselves at the obligor’s expense, nor have it repaired by a third party. Withdrawal is not available for an insignificant defect.

Warranty claims may be enforced within a two-year period calculated from the time of performance.

In the case of a contract between a consumer and a business, it must be presumed, until proven otherwise, that a defect recognised by the consumer within one year of performance already existed at the time of performance, unless this presumption is incompatible with the nature of the item or the nature of the defect. After one year following performance, the burden of proving defective performance falls on the consumer.

In the case of a contract between a consumer and a business, a defect communicated within two months of its discovery must be regarded as communicated without delay.

Under Section 6:157(2) of the Civil Code, in a contract between a consumer and a business, any stipulation that derogates, to the detriment of the consumer, from the Civil Code’s provisions on warranty for defects and guarantee is void.

5.2 The costs relating to the fulfilment of the warranty obligation — including in particular material, labour, and delivery costs — are borne by the obligor.

If the entitled party’s failure to fulfil their maintenance obligation also contributed to the malfunction of the item, the entitled party must bear the costs arising from the fulfilment of the warranty obligation in proportion to their contribution, provided they had knowledge relevant to the maintenance of the item, or the obligor fulfilled its information obligation in this respect.

In the case of replacement or withdrawal, the consumer is not obliged to compensate for any reduction in the value of the item that results from normal use.

The obligor is obliged to compensate the entitled party for damage arising from defective performance, unless the obligor is exempted from liability for the defective performance. The entitled party may claim compensation for damage caused to the subject matter of the service by defective performance where repair or replacement is not available, or where the obligor did not undertake repair or replacement, is unable to fulfil this obligation, or where the entitled party’s interest in repair or replacement has ceased. This claim for damages becomes time-barred within the period specified for enforcing warranty-for-defects rights. The entitled party may also enforce their claim for damages as a defence against a claim arising from the same contract, even if the claim for damages has become time-barred.

5.3 Under Section 3(1) of NGM Decree No. 19/2014 (IV. 29.) on the procedural rules for handling warranty and guarantee claims relating to goods sold under a contract between a buyer and a trader (hereinafter the “Decree”), when enforcing a warranty claim, the consumer must prove that the contract was concluded. If the business disputes that the contract was concluded, it must draw the consumer’s attention to the possibility of lodging a complaint and to the manner of handling the complaint, in accordance with the Consumer Protection Act. Under Section 3(2) of the Decree, the conclusion of the contract must be regarded as proven if the consumer presents proof of payment of the consideration — the invoice or receipt issued under the VAT Act.

5.4 Under Section 4 of the Decree, the business must take a written record of any warranty or guarantee claim reported to it by the consumer, recording:

  1. the consumer’s name and address
  2. the description and purchase price of the movable item sold under the contract between the consumer and the business,
  3. the date of the business’s performance of the contract,
  4. the date the defect was reported,
  5. a description of the defect,
  6. the right the consumer wishes to enforce on the basis of their warranty or guarantee claim, and
  7. the manner in which the warranty or guarantee claim is to be settled, or the reason for rejecting the claim or the right sought to be enforced on its basis.

If the business fulfils its warranty or guarantee obligation in a manner other than that sought by the consumer, the reason for this must be stated in the written record.

The written record must include information that, in the event of a consumer dispute, the consumer may also initiate proceedings before the conciliation board operated by the county (metropolitan) chambers of commerce and industry.

A copy of the written record must be provided to the consumer without delay, in a verifiable manner.

If, when the claim is reported, the business is unable to state whether the consumer’s warranty or guarantee claim can be satisfied, it must notify the consumer of its position — including, if the claim is rejected, the reason for rejection and the option of turning to the conciliation board — within five working days, in a verifiable manner.

The business must retain the written record taken of the consumer’s warranty or guarantee claim for three years from the date it was taken, and must present it to the supervisory authority upon request.

5.5 Under Section 5 of the Decree, the business must endeavour to carry out the repair or replacement within fifteen days at most. If the repair or replacement takes longer than fifteen days, the business must inform the consumer of the expected duration of the repair or replacement. This information is provided electronically, subject to the consumer’s prior consent, or in another manner suitable for proving receipt by the consumer.

Under Section 6(1) of the Decree, in order to carry out a repair, or — in the case referred to in Section 4(5) of the Decree — to examine whether a warranty or guarantee claim can be satisfied, the movable item must be received against a receipt indicating:

  1. the consumer’s name and address,
  2. the data necessary to identify the item,
  3. the date the item was received, and
  4. the date on which the consumer may collect the item.

The requirements of Section 6(1) of the Decree may also be satisfied within the written record taken of the warranty or guarantee claim.

6. Right of withdrawal and termination

6.1 In the case of a home-delivered order, please check upon receipt, item by item, that the product(s) are undamaged, check any other accessories included in the package, and check the accuracy of the details shown on the invoice. If you notice a discrepancy, you have the option of returning the parcel. Please inform us of any observations so that we can remedy the problem that has arisen. Products are delivered exclusively to addresses in Hungary. We do not deliver to PO box addresses.

6.2 Under Section 20(1) of Government Decree No. 45/2014 (II. 26.) on the detailed rules of contracts between consumers and businesses (hereinafter the “Government Decree”), in the case of a contract concluded off-premises and a distance contract, the consumer has the right of withdrawal without giving reasons, within the period specified in Section 20(2). In the case of an off-premises contract or a distance contract for the provision of a service, if performance begins following the declaration referred to in Section 13 or Section 19 of the Government Decree, the consumer has the right of termination without giving reasons, within the period specified in Section 20(2).

Under Section 20(2) of the Government Decree, the consumer may exercise their right of withdrawal or termination under Section 20(1)

  1. in the case of a contract for the sale of goods, within
    1. the goods,
    2. in the case of the sale of multiple goods, where the individual goods are supplied at different times, the last good supplied,
    3. in the case of goods consisting of multiple items or pieces, the last item or piece supplied,
    4. if the goods are to be supplied regularly over a specified period, the first supply,

    being taken possession of by the consumer or a third party, other than the carrier, indicated by the consumer;

  2. in the case of a contract for the provision of a service, from the date the contract is concluded

within fourteen days.

The provisions of Section 20(2)(a) of the Government Decree do not affect the consumer’s right to also exercise the right of withdrawal specified in Section 20 of the Government Decree in the period between the date the contract is concluded and the date the goods are received.

If the consumer made the offer to conclude the contract, the consumer has the right, before the contract is concluded, to withdraw the offer, which terminates the binding nature of the offer with respect to concluding the contract.

Under Section 22(1) of the Government Decree, the consumer may exercise the right granted under Section 20 of the Government Decree by using the model withdrawal statement found in Annex 2 to the Government Decree, or by means of another unambiguous statement to that effect.

Under Section 22(3) of the Government Decree, the right specified in Section 20 must be regarded as exercised in time if the consumer sends their statement before the deadline specified in Section 20(2) or Section 21 expires.

The consumer bears the burden of proving that the right specified in Section 20 was exercised in accordance with Section 22.

Under Section 23(1) of the Government Decree, if the consumer withdraws from the off-premises or distance contract in accordance with Section 22 of the Government Decree, the business must, without delay but no later than fourteen days from becoming aware of the withdrawal, reimburse the full amount paid by the consumer as consideration, including any costs incurred in connection with performance.

Under Section 23(4) of the Government Decree, in the case of a contract for the sale of goods, the business may withhold the amount specified in Section 23(1) of the Government Decree until the consumer has returned the goods, or has provided undeniable proof that they have been sent back — whichever occurs first. The business does not have the right of withholding if it undertook to collect the goods itself.

6.3 Németh-Tavasz Brigitta Györgyi Egyéni Vállalkozó is obliged to refund the full purchase price only upon the return of a product that is — apart from damage to the packaging that is unavoidable when unwrapping it — undamaged, complete, and used only to the extent necessary to establish the nature, characteristics, and functioning of the product. Exercising the right of withdrawal entails no additional cost for the customer, but the customer is responsible for arranging the return of the product, and the direct cost of the return is borne by the customer.

Provided the returned parcel meets the above conditions, Németh-Tavasz Brigitta Györgyi Egyéni Vállalkozó undertakes to fulfil its obligation under Section 23(1) of the Government Decree, having regard to Section 23(4) of the Government Decree.

In the event of withdrawal or termination, the business refunds the amount due to the consumer using the same payment method the consumer used. With the consumer’s express consent, Németh-Tavasz Brigitta Györgyi Egyéni Vállalkozó may use a different payment method for the refund, but the consumer may not be charged any additional fee as a result.

If the consumer expressly chooses a mode of transport other than the least costly standard mode of transport offered, Németh-Tavasz Brigitta Györgyi Egyéni Vállalkozó is not obliged to reimburse the resulting additional costs.

6.4 The consumer’s obligations upon withdrawal

If the consumer withdraws from the off-premises or distance contract in accordance with Section 22 of Government Decree No. 45/2014 (II. 26.), they must, without delay but no later than fourteen days from communicating the withdrawal, send the goods back or hand them over to the business, or to a person authorised by the business to receive the goods, unless the business undertook to collect the goods itself. The return is deemed to have been made within the deadline if the consumer sends the goods before the deadline expires. The consumer bears the direct cost of returning the goods, unless the business undertook to bear this cost, or the consumer hands the goods over at the distributor’s premises. If, at the same time the off-premises contract was concluded, the goods were delivered to the consumer, the business returns the goods at its own expense if, due to their nature, they cannot be returned by post. In the case of a distance contract, if the business also sells the goods at physical premises, and the consumer exercises their right under Section 20 in person at the business’s premises, they are entitled to return the goods to the business at the same time.

The consumer is liable only for any diminished value of the goods resulting from use beyond what is necessary to establish the nature, characteristics, and functioning of the goods. The consumer is not liable for diminished value if the business failed to fulfil its information obligation under Section 11(1)(i) of the Government Decree.

7. Complaint handling

It is our store’s goal to fulfil every order to a proper standard, to the customer’s complete satisfaction. If, however, the consumer has any complaint regarding the contract or its performance, they may communicate their complaint by phone at +36 20 959 8797, by e-mail at hello@brigittatavasz.com, or by letter.

7.1 Németh-Tavasz Brigitta Györgyi Egyéni Vállalkozó examines received complaints immediately and remedies them where necessary. If the customer does not agree with the handling of the complaint, or if immediate investigation of the complaint is not possible, the Provider takes a written record of the complaint and its position on it without delay, and sends a copy of it to the customer.

7.2 A consumer complaint must be sent in writing to the e-mail address hello@brigittatavasz.com, or as recorded post to the address 1044 Budapest, Kálvin János u. 35., in a manner suitable for identifying the consumer and the transaction affected by the complaint, together with an e-mail address or postal address suitable for a reply. Németh-Tavasz Brigitta Györgyi Egyéni Vállalkozó investigates the complaint within 14 days and sends the consumer a reasoned reply, in a verifiable manner to the contact details provided by the consumer, regarding the outcome of the investigation and any proposed solution.

7.3 The written record taken of the complaint must contain the following:

  1. the consumer’s name and address,
  2. the place, time, and manner in which the complaint was made,
  3. a detailed description of the consumer’s complaint, and a list of the documents, records, and other evidence presented by the consumer,
  4. the business’s statement of its position on the consumer’s complaint, if immediate investigation of the complaint is possible,
  5. the signature of the person taking the record and — except in the case of a verbal complaint communicated by phone or another electronic communications service — the consumer’s signature,
  6. the place and time the record was taken,
  7. in the case of a verbal complaint communicated by phone or another electronic communications service, the complaint’s unique identification number.

Németh-Tavasz Brigitta Györgyi Egyéni Vállalkozó retains the written record taken of the complaint and a copy of the reply for 3 years, and presents them to the supervisory authorities upon request.

7.4 If the consumer’s complaint is rejected, or if they consider it to have been handled inadequately, they may initiate proceedings before an authority or a conciliation board, as follows (the Provider has not made a general submission declaration):

7.4.1 The consumer may lodge a complaint with the consumer protection authority:

Under Government Decree No. 387/2016 (XII. 2.) on the designation of the consumer protection authority, the county government office acts as the general consumer protection authority: https://kormanyhivatalok.hu/kormanyhivatalok

7.4.2 In the event of a complaint, the consumer has the option of turning to the conciliation board with jurisdiction over their place of residence or stay; their contact details can be found here:
